For the streaming of films on the video-on-demand platform www.goethe-on-demand.de including its subdomains, subpages and mobile applications (hereinafter: VOD platform), the following General Terms and Conditions apply exclusively in the form valid at the time the contract was concluded. Any general terms and conditions of the contractual partner do not apply to this contractual relationship. Streaming within the meaning of these terms and conditions is the temporary use of a film without a permanent copy on the customer’s device.
Rushlake Media GmbH hosts the Goethe-on-Demand service for the Goethe-Institut. Contracts for streaming films on the VOD platform are concluded exclusively between the customer and the

(hereinafter: provider). Direct legal relationships with other natural or legal persons are not established. The responsibility for the VOD platform is exclusively that of the provider.
The range of films on the VOD platform can generally be viewed without prior registration. To stream films via the VOD platform, a customer account must be registered in advance. When registering, the customer must provide the following data: name, full address, e-mail address. Registration is confirmed with the customer by e-mail. Upon receipt of the confirmation e-mail, a framework contract for the use of the VOD platform is concluded between the customer and the provider. There is no entitlement to registration.
After entering their log-in data on the VOD platform, customers can add a film to their shopping cart. It may be necessary to enter a voucher code. When the order is sent, the time-limited activation of the ordered film takes place.
The ordered films can be viewed on the VOD platform after the ordering process has been completed and activated by the provider. The following system requirements are necessary for the customer to stream:
Windows: x86 or x64 processor with 1.6 GHz or faster (64-bit is only supported for Internet Explorer), 512 MB RAM
Mac: 1.83 GHz or faster Intel Core Duo processor, 512 MB RAM
iOS: Version 12 or higher
Android: Version 6 or higher
The following are the recommended internet download speeds per stream for watching films on the VOD platform.
0.5 Mbit/s – min. required broadband speed
1.5 Mbit/s – recommended broadband speed
3.0 Mbit/s – recommended for standard definition
5.0 Mbit/s – recommended for HD quality
25 Mbps – recommended for Ultra HD quality
You can achieve a speed of 1.5 Mbit/s with any DSL-2000 line, which you should, however, not use for any other activities such as surfing, checking e-mails or Facebook when streaming.
Depending on the internet connection, the service provider and rates, additional costs may arise that must be borne by the customer. It is the responsibility of the customer to find out about any additional costs and to ensure that their end devices meet the technical system requirements for using the VOD platform.
The provider can restrict the access and availability of the VOD platform if this requires avoiding disruptions to the software, stored data or the network, maintaining network integrity, data protection reasons or improper use.
The films offered are protected by copyright and ancillary copyright. For the purpose of streaming, the provider grants the customer the simple limited right of use to view the ordered film in the private sphere in the region specified in the film description for non-commercial purposes any number of times within 48 hours via the provider’s platform. Further usage rights are not granted. The customers recognise these rights.
4.1. Customers are not allowed to misuse the VOD platform. In particular, they may only use the content that has been accessed in compliance with national and international copyright law within the scope of the rights of use granted. In particular, customers are not allowed to publicly present the content accessed, to make it publicly accessible or to play it back, to save it permanently and/or locally, to send, to edit, to disseminate, to reproduce, to distribute or otherwise use it outside of the contractual agreement for a specific purpose in any form.
4.2. Customers must protect the content they have accessed from any use by unauthorised persons and from other misuse and only make content available to children or young people that has been approved for the respective age group.
The framework contract for the use of the VOD platform (section 2.2) can be terminated by either side at any time. A license agreement concluded in accordance with Section 2.3 ends automatically with the expiry of the temporary lease, without the need for termination.
Customers can find detailed information about the type, scope, location and purpose of the collection, processing and use of data for the provision of the VOD platform on the provider’s website under Privacy Policy.
The provider reserves the right to change these terms and conditions at any time with effect for the future. The provider will inform the customer of the change to the terms and conditions in writing or by e-mail. In the event of changes to non-essential contractual provisions, the consent of the customer applies if they do not object to the change in writing or by e-mail within 6 weeks of receipt of the notification of change. In the notification of changes, the provider will expressly inform the customer about the changed terms and conditions and the consequences of not objecting.
The European Commission provides a platform for online dispute resolution at the address http://ec.europa.eu/consumers/odr/. Customers can use this platform to settle disputes with the provider.
The law of the Federal Republic of Germany applies to the exclusion of the UN sales law. Should a regulation of these terms and conditions be ineffective, this shall not affect the effectiveness of the remaining regulations.
